Mijoosh.com is an online retailer of apparel and lifestyle products offered at great values to the consumer. Membership allows customers to purchase a variety of products. Upon placing an order, Mijoosh.com shall ship the product to you and be entitle to its payment for the service.

Pricing
We ensure that all details of prices appearing on the website are accurate, however errors may occur. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Additionally, prices for items may change from time to time without notice. However, these changes will not affect orders that have already been dispatched. The price of an item includes GST (or similar sales tax) at the prevailing rate for which we are responsible as a seller. Upon receiving your order, we carry out a standard pre-authorization check on your payment method to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorization check has been completed. Your Payment will be debited once the order has been accepted.
Delivery
You will be given various options for delivery of items during the order process. The options available to you will vary depending on where you are ordering from. An estimated delivery time is displayed on the order summary page. On placing your order, you will receive an email containing a summary of the order and the estimated delivery time to your location. Sometimes, delivery may take longer due to unforeseen circumstances. In such cases, we will proactively reach out to you by e-mail and SMS. However, we will not be able to compensate for any mental agony caused due to delay in delivery.
Exchange, Return and refund.
If we had delivered a product with manufacturing defect or delivered a wrong size or colour, we have no problem in acknowledging it and replacing it for you, subject to availability of item you request. Similarly, no refund will be entertained, unless we deliver you a wrong colour or wrong size or goods with manufacturing defect. Lingerie’s, Briefs, Panties, Lingerie sets, Socks and any other innerwear are never returnable and exchangeable. If the product returned does not pass the quality check, we shall ship it back to you at your cost. Say, if garment was torn, washed, stained, or mishandled while removing tags, and informed as manufacturing defect, it cannot be accepted.
If you choose to exchange the item for reason of wrong size/colour delivered or receipt of a defective item, you will be provided with a replacement of the item, free of cost, unless you place a request for refund. However, all exchanges are subject to stock availability and subject to your address being serviceable at that point of time. Please note that we are only able to offer an item of same price. If you wish to exchange our item for a product of different price, we suggest you return it and obtain refund and place a new order for required item. Hope, our customers respect the intentions behind the exchange policy and don’t abuse it.
Intellectual Property Rights
All and any intellectual property rights in connection with the products shall be owned absolutely by the Company. The platform is controlled and operated by Mijoosh.com and products are sold by respective Sellers. All material on Platform, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. The Material on Mijoosh.com is solely for Your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so.
Without the prior written consent of the owner, modification of the materials, use of the materials on any other Mijoosh.com or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks, and other proprietary rights, and is prohibited. Law and Jurisdiction
These terms shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation here to shall be subject to the exclusive jurisdiction of courts, tribunals, fora, applicable authorities at Tiruppur. The place of Jurisdiction shall be exclusively in Tiruppur.
Indemnification
You agree indemnify, defend and hold harmless Mijoosh.com.com, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys’ fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, Privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party.
Violation & Termination
You agree that the Company may, in its sole discretion and without prior notice, terminate your access to the website and block your future access if we determine that you have violated these Terms of Service or any other policies. If you or the Company terminates your use of any service, you shall still be liable to pay for any service that you have already ordered till the time of such termination.
Mijoosh.com shall not be held responsible for non-availability of the Mijoosh.com during periodic maintenance operations or any unplanned suspension of access to the Mijoosh.com The User understands and agrees that any material and/or data downloaded at Mijoosh.com is done entirely at Users own discretion and risk and they will be solely responsible for any damage to their mobile or loss of data that results from the download of such material and/or data.
To the maximum extent that is permissible under law, Mijoosh.com liability shall be limited to an amount equal to the Products purchased value bought by You. Mijoosh.com shall not be liable for any dispute or disagreement between Users.
If you or Mijoosh.com terminates your use of the Platform or any Service, Mijoosh.com may delete any content or other materials relating to your use of the Service and Mijoosh.com will have no liability to you or any third party for doing so. However, your transactions details may be preserved by Mijoosh.com for purposes of tax or regulatory compliance.
Mijoosh.com may unilaterally terminate Your account on any event as mentioned in the Terms of Use. Any credits earned through loyalty or referral program, Mijoosh.com credit and pending refunds if any will be forfeited in such case. Returns/Refund for such Users shall be at the sole discretion of Mijoosh.com.
If you use any false e-mail address or use the portal for any unlawful and fraudulent purposes, which may cause annoyance and inconvenience and abuses any policy and rules of the company or mislead Mijoosh.com by sharing multiple address and phone numbers or transacting with mala-fide intentions then Mijoosh.com reserves the right to refuse access to the portal, terminate accounts including any linked accounts without notice to you.

IN NO EVENT WILL THE COMPANY OR IT’S REPRESENTATIVES BE LIABLE FOR ANY DAMAGES, ARISING OUT OF OR RELATED TO MISUSE OF PERSONAL INFORMATION OF THE CUSTOMER AND THE CUSTOMER IS SOLELY LIABLE FOR SUCH ACTS AND THEY ARE ADVISED NOT TO SHARE THEIR CONFIDENTIAL INFORMATION LIKE MIJOOSH.COM PASSWORD, OTP, CREDIT/DEBIT CARD EXPIRY AND CVV WITH ANYONE EVEN THOUGH THEY CLAIM TO BE A MIJOOSH.COM.COMEMPLOYEE. NONE OF OUR EMPLOYEES WILL ASK FOR SUCH CONFIDENTIAL INFORMATION.
You acknowledge and undertake that you are accessing the services on the Platform and transacting at your own risk and are using your best and prudent judgment before entering any transactions through Mijoosh.com We shall neither be liable nor responsible for any actions or inactions of sellers nor any breach of conditions, representations or warranties by the sellers or manufacturers of the products and hereby expressly disclaim and any all responsibility and liability in that regard. We shall not mediate or resolve any dispute or disagreement between You and the sellers or manufacturers of the products. We further expressly disclaim any warranties or representations (express or implied) in respect of quality, suitability, accuracy, reliability, completeness, timeliness, performance, safety, merchantability, fitness for a particular purpose, or legality of the products listed or displayed or transacted or the content (including product or pricing information and/or specifications) on Platform.
